1. Acceptance of Terms

1.1 By accessing and using Peak Defence Virtual CISO services (“Services”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to all of these Terms, do not use the Services.

2. Service Description

2.1. Peak Defence Virtual CISO offering provides support for implementing and operating a compliance management system, strategic guidance, support policy and procedure development, and risk management advice related to information security compliance. It includes, but is not limited to, risk assessment, compliance management, and incident response planning and operations.

2.2. The service is provided in three tiers:

a.  Startup package

    i.  Fully hosted by Peak Defence in AWS environment (in a
        specific region, depending on the customer contract)

    ii. No data is shared between customers and no data is used for training the generic model (stored by Peak Defence), but instances themselves can be shared;

b.  Scaleup package

    i.  Fully hosted by PeakDefence in AWS environment (in a
        specific region, depending on the customer contract)

    ii. No data is shared between customers and no data is used for training the generic model (stored by Peak Defence), but instances themselves can be shared;

c.  Enterprise package

    i.  Can be hosted in customer\'s AWS instance or even locally depending on the customer contract

    ii. No data is shared between customers and no data is used for training the generic model (stored by Peak Defence);

3. User Obligations and Conduct

3.1. You agree to provide accurate and complete information as required for the use of the Services and to keep such information up to date.

3.2. You are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer.

3.3. Users are responsible for reporting any vulnerabilities observed immediately to support[at]peakdefence.com email address.

4. Privacy and Data Protection

4.1. Peak Defence is committed to protecting the privacy and security of your data. Our data handling practices are described in our Privacy Policy.

5. Intellectual Property Rights

5.1. All intellectual property rights in the Services are owned by or licensed to Peak Defence. You agree not to copy, reproduce, modify, or create derivative works from the Services.

6. Limitation of Liability

6.1. To the fullest extent permitted by law, Peak Defence shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues.

6.2. Users of service shall not attempt to abuse the service by using it outside the scope of intention as described in Service Description or as an attempt to test the limits of AI capabilities.

7. Amendments to Terms

7.1. Peak Defence reserves the right to amend these Terms at any time. You will be notified of any changes through publishing a new version on Peak Defence website. If you want to subscribe to the changes, please notify us at support[at]peakdefence.com.

8. Termination

8.1. Peak Defence may terminate your access to the Services without notice for any breach of these Terms.

9. Governing Law

9.1. These Terms shall be governed by and construed in accordance with the laws of the Estonia in which Peak Defence is located (or EU legislation if such applies).
